The Impact of the Personal Data Protection Act 2020 on Data Analytics in the Retail Industry
Data analytics, as an important means for organisations to harness their data and identify new opportunities, is used in a wide range of industries, including retail, healthcare, life sciences, manufacturing and finance. Data analytic commonly involves the processing of personal data and this sets into motion the operation of the PDPA. The aim of the PDPA is to regulate the processing of personal data in commercial transactions. However, the PDPA does not contain provisions that deal with issues presented by data analytics and this lacuna needs to be addressed by Parliament. The issues highlighted in Part VI of this paper are some of the more evident concerns and it is timely for the PDPA to include a part dealing with the legal obligations of stakeholders in the processing of personal data for analytics purposes. Equally important is the need to clarify the legal status of inferred data.
